Welcome to Nexcart LLC. These Terms & Conditions govern your use of our website and the design, development, and marketing services we provide. By visiting our site or engaging us for a project, you agree to the terms below.
We provide web design, web portal and mobile app development, SEO, digital marketing, e-commerce development, logo design, creative copywriting, video animation, and marketing collateral services, typically delivered through the packages described on our Packages page or a custom project quote.
To keep your project on track, you agree to:
Provide accurate project details, brand assets, and content in a timely manner.
Respond to review requests and provide clear, consolidated feedback.
Confirm you own or have the rights to any content, images, or trademarks you supply to us.
Projects are billed according to the package or quote agreed before work begins. An upfront deposit is typically required to reserve and start a project, with the balance due on the agreed milestones or on completion. Please see our Refund Policy for details on cancellations and refunds.
Once a project is paid in full, ownership of the final approved deliverables (design files, website code, or creative assets produced specifically for you) transfers to you. Until full payment is received, all work remains the property of Nexcart LLC. We may showcase completed work in our portfolio unless you request otherwise in writing.
Each package or quote includes a defined number of revision rounds. Additional rounds beyond what was agreed may be billed separately at our standard rates.
Some projects rely on third-party platforms, plugins, hosting providers, or app stores (for example, WordPress, Shopify, Google, or Apple). We are not responsible for outages, policy changes, or fees charged directly by these third parties.
We treat your project details and business information as confidential and will not share them with third parties except as needed to deliver the service or as required by law.
We provide estimated timelines for each project. Delays in receiving content, feedback, or approvals from you may extend the schedule. We will communicate any significant timeline changes promptly.
While we aim for excellent results, we cannot guarantee specific rankings, traffic, sales, or business outcomes. We are not liable for indirect or consequential damages, or for issues arising from third-party services outside our control.
Either party may end an engagement in cases of non-payment or a material breach of these terms. If a project is terminated, you remain responsible for payment for work already completed.
These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles.
We may update these Terms & Conditions from time to time. The latest version will always be posted on this page, and continued use of our services means you accept the current version.
